The following terms and conditions apply to all users who access or use the Work For Lodgings website portal (Work For Lodgings Platform), or otherwise indicate their acceptance to this agreement (Agreement).
Scope of Work For Lodgings Service
The service provided by Work For Lodgings is accessible on the Work For Lodgings Website (Site) or Platform www.workforlodgings.com
The Work For Lodgings Platform is an online service to connect workers (Guest-workers) with people who can provide accommodation (Hosts) to enable the exchange of work effort for lodgings. Hosts publish information (Project) describing the work for which they seek help and the accommodation they can provide. Guest-workers publish information about their skill set and the accommodation they seek.
Please read these Terms and Conditions carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the Work For Lodgings Platform, you agree to comply with and be bound by these Terms and Conditions, whether or not you become a registered member on the Site.
The Site enables Guest-workers and Hosts (collectively, Members) to connect. If you choose to use the Work For Lodgings Platform, you do so voluntarily and at your sole risk. The Work For Lodgings Platform is provided “as is”, without warranty of any kind, either express or implied. You agree that the Work For Lodgings Platform is not a party to any agreements entered into between Guest-workers and Hosts nor is the Work For Lodgings Platform a travel agency, an organized exchange program, an agent or an insurer. The Work For Lodgings Platform does not monitor Guest-workers and Hosts and disclaims all liability in this regard.
Eligibility
You must be at least 18 years old to access and use the Work For Lodgings Platform or register a Work For Lodgings account (Member Account). By accessing or using the Work For Lodgings Platform you represent and warrant that you are 18 or older.
Site user verification on the Internet is difficult and Work For Lodgings does not assume any responsibility for the confirmation of identity of any Guest-worker or Host . However, for transparency and fraud prevention purposes, and as permitted by applicable laws, Work For Lodgings may, but has no obligation to (i) ask Guest-workers and Hosts to provide a form of government identification or other information or undertake additional checks designed to help verify their identities or backgrounds, (ii) screen Guest-workers and Hosts against third party databases or other sources and request reports from service providers, and (iii) where sufficient information is given to identify a Guest-worker or Host, obtain reports from public records of criminal convictions or sex offender registrations or an equivalent version of background or registered sex offender (if available).
Account Registration
You must register a Member Account to access and use certain features of the Work For Lodgings Platform, such as publishing a Project or applying for a Project. For Hosts there is no fee for registering on the Work For Lodgings Platform. Hosts can create a Project listing which describes the work to be done and the accommodation on offer. Guest-workers make contact with a Host through the Site by making an online application for a Work For Lodgings Project. Although Work For Lodgings Projects can be viewed without registering, Guest-workers and Hosts must have registered accounts in order contact each other.
Guest-workers are charged a fee for account registration for 1 year on the Work For Lodgings Platform. A registered Guest-worker can create a profile, upload photos, browse Hosts and Work For Lodgings Projects, and apply for Work For Lodgings Projects. Guest-workers can be contacted by Hosts and can contact Hosts and other Guest-workers.
General Obligations
When registering a Member Account on the Work For Lodgings Platform, you must provide accurate, current and complete information during the registration process and keep your Work For Lodgings Member Account profile page information up-to-date at all times.
By creating, uploading, posting, sending, receiving, storing, or otherwise making available any member content (Member Content) on or through the Work For Lodgings Platform, you grant to Work For Lodgings a non-exclusive, worldwide, royalty-free, irrevocable, perpetual (or for the term of the protection), sub-licensable and transferable license to such Member Content to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit in any manner such Member Content to provide and/or promote the Work For Lodgings Platform, in any media or platform.
You will not post, upload, publish, submit or transmit any Member Content that: (i) is fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive, (ii) is defamatory, libelous, obscene, pornographic, vulgar or offensive, (iii) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group, (iv) is violent or threatening or promotes violence or actions that are threatening to any other person or animal, (v) promotes illegal or harmful activities or substances, or (vi) violates any Work For Lodgings policy. Work For Lodgings may, without prior notice, remove or disable access to any Member Content that Work For Lodgings finds to be in violation of these Terms or then-current Policies or Standards of Work For Lodgings, or otherwise may be harmful or objectionable to Work For Lodgings, its Members, third parties, or property.
You acknowledge that as the provider of the Work For Lodgings Platform, Work For Lodgings does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Host Projects, nor is Work For Lodgings an organizer or retailer of travel packages. Hosts alone are responsible for their Project listings. When Guest-workers and Hosts make or accept an agreement to exchange work for accommodation, they are entering into an agreement directly with each other. Work For Lodgings is not and does not become a party to or other participant in any relationship between Members, nor is Work For Lodgings a travel agency, organized exchange program, an agent or an insurer.
You acknowledge that Work For Lodgings has no obligation to monitor the access to or use of the Work For Lodgings Platform by any Member or to review, disable access to, or edit any Member Content, but has the right to do so. Work For Lodgings reserves the right to remove and terminate any Member Account without warning.
If you feel that any Member you interact with, whether online or in person, is acting or has acted inappropriately, including but not limited to anyone who (i) engages in offensive, violent or sexually inappropriate behavior, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you will immediately report such person to the appropriate authorities and then to Work For Lodgings by contacting us with your police station and report number (if available). You agree that any report you make will not obligate us to take any action (beyond that required by law, if any).
Host Obligations
When you register as a Host, you acknowledge that (i) other Members of Work For Lodogings will be able to view your profile and contact you, (ii) Work For Lodgings does not guarantee that you will find a suitable Guest-worker.
When creating a Project on the Work For Lodgings Platform you agree to (i) provide complete and accurate information about your Host Project (such as listing description, location, and availability) and (ii) disclose any deficiencies, restrictions (such as house rules) and requirements that apply (such as any minimum age, proficiency or fitness requirements for work). You are responsible for keeping your Project information (including availability) up-to-date at all times.
Pictures, animations or videos (collectively, Images) used in your Work For Lodgings Projects must accurately reflect the quality and condition of your Host accommodation and work requirements. Work For Lodgings reserves the right to require that Projects have a minimum number of Images of a certain format, size and resolution.
Work For Lodgings does not have any obligation to screen any Guest-worker, and cannot confirm the accuracy or completeness of any Guest-worker identity or profile. Work For Lodgings assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, reliability, or availability of any Guest-worker profile. You acknowledge that you are solely responsible for verifying the information provided by any Guest-worker that you contact. You acknowledge that Work For Lodgings is not, in any way, responsible for any damage caused to accommodation.
You agree that some experiences and events may carry inherent risk, and by inviting a Guest-worker into your home, you choose to assume those risks voluntarily. For example, your Host Projects may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by offering those Host Projects. You assume full responsibility for the choices you make before, during and after your participation in your Host Project. You agree to release and hold harmless Work For Lodgings from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs during your Host Projects.
You agree not to offer through the Work For Lodgings Platform, as a Host, any accommodation that you do not yourself own or have permission to make available for residential purposes.
Guest-worker Obligations
When you register as a Guest-worker, you acknowledge that (i) Work for Lodgings fees must be paid before you can contact a Host, (ii) other Work For Lodgings Members will be able to view your profile and contact you, (iii) Work For Lodgings does not guarantee that you will find a suitable host.
Work For Lodgings does not have any obligation to screen any Host or Host Project, and cannot confirm the accuracy or completeness of any Host profile or Project published by any Host, including the identity of such Host. Work For Lodgings assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, reliability, or availability of any Host profile or Project. You acknowledge that you are solely responsible for verifying the information provided by any Host that you contact, and you are fully responsible for confirming that the Host Project that you choose meets your requirements.
You should carefully review the description of any Host Project you intend to apply for to ensure you meet any minimum age, proficiency, fitness or other requirements which the Host has specified in the Project. At your sole discretion you may want to inform the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate in work demanded in the Host Project. In addition, certain laws, like the minimum legal drinking age in the location of the Host Project, may also apply. You acknowledge that you are responsible for identifying, understanding, and complying with all laws, rules and regulations that apply to your participation in a Host Project.
You agree that some experiences, events, or Host Projects, may carry inherent risk, and by participating in such Projects, you choose to assume those risks voluntarily. For example, some Host Projects may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Projects. You assume full responsibility for the choices you make before, during and after your participation in a Host Project. You agree to release and hold harmless Work For Lodgings from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs during a Host Project.
As a Guest-worker, you are responsible for leaving the accommodation offered in the Projects in which you participate (including any personal or other property located at the accommodation) in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the accommodation. You acknowledge that Work For Lodgings is not, in any way, responsible for any damage caused to accommodation.
Prohibited Activities
By using the Work For Lodgings Platform, you agree that you are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to any agreement you make with any Guest-worker, Host or third party. In connection with your use of the Work For Lodgings Platform, you will not and will not assist or enable others to:
- imply any partnership or otherwise that misleads others as to your affiliation with Work For Lodgings
- violate any applicable laws or regulations, agreements with third-parties, third-party rights, or our Terms and Conditions, Policies or Standards
- use the Work For Lodgings Platform for any commercial or other purposes that are not expressly permitted by these Terms and Conditions
- use any robots, spider, crawler, scraper or other automated means or processes to access, collect data or other content from or otherwise interact with the Work For Lodgings Platform for any purpose
- copy, store or otherwise access or use any information, including personally identifiable information about any other Member, contained on the Work For Lodgings Platform in any way that is inconsistent with Work For Lodgings Privacy Policy or these Terms and Conditions, or that otherwise violates the privacy rights of Members
- attempt to recruit or otherwise solicit any Member to join third-party services, applications or websites, without the prior written approval of Work For Lodgings
- discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engage in any violent, harmful, abusive or disruptive behavior
- violate or infringe anyone else’s rights or otherwise cause harm to anyone.
No Warranty
Work For Lodgings does not warrant any Host Project or quality of accommodation, nor any Guest-worker profile. You understand that the Images on the Site are for information purposes only. You acknowledge that in case you would seek any legal remedy for actions or omissions of Guest-workers or Hosts, or any third parties, you will not claim any liability against Work For Lodgings.
Work For Lodgings and its affiliates, and its and their third-party licensors, expressly disclaim to the fullest extent permitted by law all warranties, whether express, implied, statutory or otherwise, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. Work For Lodgings and its affiliates, and its and their third-party licensors, disclaim any warranties regarding the security, reliability, and performance of the Site, and all materials, information, advice, Project listings, Member Content, products and services available on or through the Site.
You agree that you download or otherwise obtain material or data through the use of the Work For Lodgings Platform at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from downloading or obtaining any such material or data.
Feedback
Work For Lodgings welcomes and encourages you to provide feedback, comments and suggestions for improvements to the Work For Ldogings Platform (Feedback). You may submit Feedback by emailing us, through the contact section of the Work For Lodgings Platform, or by other means of communication. Any Feedback you submit to us will be considered non-confidential and non-proprietary to you. By submitting Feedback to us, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.
Indemnification
You agree to defend, indemnify and hold Work for Lodgings and its affiliates and subsidiaries, including but not limited to, Work For Lodgings officers, directors, employees and agents, harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising out of or in any way connected with: (i) your violation of any term of this Agreement, (ii) your use of, and access to the Work For Lodgings Platform, (iii) your loss of, or disclosure of, information gained from using the Work For Lodgings Platform, (iv) your violation of any applicable laws or regulations, including but not limited to any applicable tax, employment, equality, or discrimination laws, and any applicable data protection or privacy laws, (v) your violation of any third party right, including without limitation any copyright, property, or privacy right, (vi) any claim that your Member Content caused damage to a third party, (vii) your interaction with any other Member, stay at a Project accommodation, participation in Project work, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, work participation or use, or (viii) your actions as a Guest-worker or Host. You also agree that you have a duty to defend Work For Lodgings against such claims. You agree that this indemnity extends to requiring you to pay for reasonable legal fees for Work For Lodgings, court costs, settlements and disbursements. This defense and indemnification obligation will survive this Agreement and your use of the Work For Lodgings Platform.
Miscellaneous
Work For Lodgings reserves the right to modify these Terms and Conditions at any time in accordance with this provision. If we make changes to these Terms and Conditions, we will publish the revised Terms and Conditions on the Work For Lodgings Platform. Work For Lodgings will also endeavor to provide you with notice of the modifications by email. If you disagree with the revised Terms and Conditions, you may terminate this Agreement with immediate effect. If you do not terminate your Agreement when the revised Terms become effective, your continued access to or use of the Work For Lodgings Platform will constitute acceptance of the revised Terms and Conditions.
Work For Lodgings may, at any time and without liability, modify or discontinue all or part of the Work For Lodgings Platform (including access to the Site via any third-party links); charge, modify or waive any fees required to use the Site; or offer opportunities to some or all Site users.
The Work For Lodgings platform contains links to other sites (External Sites) on the Internet which are owned and/or operated by third-party vendors and other third parties. You acknowledge that Work For Lodgings is not responsible or liable for any such third parties or for the availability of, or the materials located on or through, any External Sites.
These Terms and Conditions are governed by French law and you agree to submit to the non-exclusive jurisdiction of the French courts for any disputes which might arise between you and Work For Lodgings in relation to Work For Lodgings, unless we both agree otherwise.
If your Country of Residence is in the EU you can access the European Commission’s online dispute resolution platform here: https://ec.europa.eu/consumers/odr. Please note that Work For Lodgings is not committed nor obliged to use an alternative dispute resolution entity to resolve disputes with Members.
